![]() Member Honoured with Order of Australia Chartered Institute of Arbitrators Member, Professor David Barker, was awarded a Member of the Order of Australia in the recent Queen's Birthday Honours List for 2006. The citation for the award stated that it was "for service to legal education in Australia and the Pacific region, to professional associations, and to the community." The Australian Branch congratulates Professor Barker on his achievement. US Supreme Court Reaffirms Fundamental Arbitration Principles A United States Supreme Court decision earlier this year has reaffirmed the fundamental principles underlying the US Federal policy in favour of arbitration. A seven to one vote reversed the Florida Supreme Court decision that found no provision of an agreement that violates state law, and may be criminal, should be enforced. The US Supreme Court rejected that state law could bar enforcement of the provisions of Section 2 of the Federal Arbitration Act. It found that a challenge to the validity of the contract, not just the arbitration clause, must go to the arbitrator.
