Building security of payment

The Australian Branch of the Institute is an Authorised Nominating Authority (ANA) under the Building & Construction Industry Security of Payment Act 2002 (Vic) administered by the Building Commission of Victoria and accordingly is able to provide adjudicators to act in contract payment disputes.
Under the Act, the following can make progress claims for payment:

  • Contractors against clients
  • Sub-contractors against contractors
  • Suppliers of materials or building components against purchasers
  • Architects, engineers and others providing building advice against clients


The Branch's Panel consists of adjudicators widely experienced in the building and construction industry and requests for adjudicators should be initially directed to the Branch Executive Officer.

Following recent amendments to the Building and Construction Industry Security of Payment Act (NSW), the Branch is no longer an ANA under that Act.
